Did you have to go to the small claims court?

Nope - requested bank statements Feb 07. Wrote letter 30 March.  Received letter from RBS saying they were looking at my case 3 weeks ago. Just about gave up and was going to write another letter this weekend which is the threatening one but came home today to the letter with offer of all charges but not interest so i've accepted!

Also an opportunity to let people who have paid off or moved a mortgage over the last few years know, that if you were charged the current redemption fee & it's more than it is in the literature relevant to the time you took it out, you can claim back the difference.  I got £50 back from Standard Life bank with one letter.

Alliance & Leicester are being pigs about mine, for about £505. I've got it passed to the local magistrates court and I'm waiting on a hearing date, which I'll then need to compile a case file; me being the prosecution.

There's not a hope in hell that A&L will actually turn up at court, but they are just stalling. It's costing them more doing it this way, but I suppose it's so they don't get a torrent of people doing it. I would imagine with RBS, if folk get wind of how easy it is, especially for serious amounts like £3500, then every man and his dog will be doing it.

Congratulations, I wish mine was going to be so easy.

Well unfortunately everyone HAS got wind of it. When i was looking into it in Feb everyeone was doing it, then last week i checked the moneysavingexpert site and it was saying banks are stalling more now and many are refusing to pay out, court isnt guaranteed and they recommended going to financial obudsman but takes ages...  so i had given up, was doing one last letter but decided against court - but hey - no need they came through!

Good luck with your claim - hope they pay up!

I've got £4000 back so far, and there's another £4000 I'm due because the idiots didn't keep the original credit agreement. I've just got to tie up the loose ends on that, then do Barclaycard and Natwest.

I am pleased for you.  Unfortunately after the Halifax stated that they had fairly charged me I requested by recorded delivery twice for all my paperwork to be returned. I had researched copied and highlighted this myself which took several hours.  I even enclosed a stamped addressed envelope.  I have now e-mailed the ombudsman EVERY DAY for a week for guidance as to how I can force the Halifax to return my documents.  Neither have they had the courtesy to reply.
To rub salt in the wound a local film director from Brighton asked for her charges back from the Halifax and received them a week before my request (not at Court!).  She requested successfully £3,400 and £800 from the Abbey mine were nowhere near that.
I further wrote to the Halifax and asked why I being a Pensioner was any different to the film Director - I begin to wonder if with her job she has clout?
Needless to say the Halifax have still not had the courtesy of a reply.
I would add when I first requested the charges back I received 4 letters all with photocopied signatures within a 4 week span - 4 different names stating they were looking into it.  Strange the 5th reply of rejection came within 24 hourse of the Berwick v Lloyds case.
What people do not realise of course as I pointed out to Halifax Lloyds had offered an amount so technically admitted they had overcharged but Mr Berwick took them to Court purely to retrieve all his money.
Since I requested my charges returned I have received two more! One for 58p over the overdraft!!!!
SO I WILL PRESS ON AND HOPE THOUSANDS MORE WILL.

Good luck - if you dont try and all that.  My money went into my bank 2 days ago - and.... I bought a Car! Grand Vitara Diesel...  ;D
