I think I`d go back through the history of the site. Who gave the land and what was their intention, did they make any restrictive covenant for example?

Do their family still have a connection in the area? Will they get involved in any protest?

And I`d look at the set up documents of the charity.

We are having a similar problem in Grantham. HOwever, ours in privately owned.... a good book is the allotment hand book which details law and allotments and had things in which our lawyer didnt know so worth a look! http://www.organiccatalog.com/catalog/product_info.php?cPath=63_194&products_id=2168

The first port of call woudl be the title deeds - i expect there would be a restrictive covenant on them.... so take a look.
