Anyone know the situation regarding the above that have self set on allotment sites. I have one that is in the Middle of my  plot which has been there for a few years and is now 8ft tall. I have been told that I can cut it down but am I likley to fall foul of the Local Council.

I very much doubt it was self set - most like a squirrel burying its winter supplies. If its in the middle of a plot  I doubt the council know its there, were it me and given its in the way I'd remove it. Unless you're going to do it with a 25 tonne JCB it won't survive being moved.

Unless the Council has documented evidence that it existed it should be assumed it never existed.

Dig it out, there can't possibly be a TPO on something that small! I get oaks and hazels every year, it has to be squirrels.

Squirrels pierce the acorn shell with their teeth as they carry them, very few survive to grow! Most of the random oaks are planted by Jays, which do not damage the acorn before burying.
rgds, Tony ;)
You couldn't make it up!

Come to think of it, I've seen loads of cracked acorns. Jays would make sense, as I see them more than squirrels on the site.

Err, you did say its an allotment didnt you, that place where you grow vegetables. I would say this is a self set oak and as it is not something you planted then it is a weed.

The oak like all trees are wonderful things (in there right place ). Why not try to transplant it somewhere.
