Hello,

We are going to the next Parish council meeting on the 2nd as we have written out our tenancy agreements for addoption by the pc.

What I need to know is ' is it written anywhere in allotment law that sheds on plots are seen as been essential to plot use?
or, a legal part of allotment essentials that needs a byelaw in order to prevent a shed being put on a plot?

I hope this make sense, we have a pc member who is trying to prevent plot holders from having sheds and we need to challenge this from a legalish standpoint me thinks!

So please help me please?

I have just signed my new amended contract last weekend for the coming year. It stipulates that allotments are entitled to 1x shed & 1x greenhouse. Maximum measurements are listed along with a sketch. But - this is what has been laid down by our borough council. So it may well be that the decision lies which each individual authority. Worth phoning to ask prior to the parish meeting me thinks?

Thank you for your replies.

i am sure that you do not need planning permission for a shed as it is a temporary structure and under the powers of that parish it provides a function to the plot holder there fore it is allowable?

mmmm your info has got me started i'm off to look further.

Temporary structures are probably ok if they are not on a permanant base (concrete).  ;D ;D ;D

 ??? yes, i'm feeling a bit miffed at the moment. Bunjies and I spent a good 3 hours last weekend pulling together a whole load of tenancy agreemnets and practical ideas to form a tenancy agreement with the Chair of the parish council.
We debated a few of the points and came to a practical agreement that would work for everyone.
One was for animals in plots. We agreed this could be done with permission from the Parish council but agreed that the site was not safe enough to keep animals over night, so people could take dogs on leads, rabbits and poultry in pens to be taken home when you left.
We also agreed sheds specific dimensions 6x4 all painted green with a water butt being compulsory within 1 month of being erected in order to harvest water.
Also £30. deposite per plot to be returned when the plot holder left with the plot in good order. If not then this £30. would either pay the rent for the first year of someone prepared to take on a poor plot, or it would pay for the Parish council gardener to put right the plot. As we felt there needed to be an incentive to give a plot back if you were struggling.
This was agreed with the chair of said parish council.
2 days later we received an email stating, no animals, and a claus to pay an unstated amount to put back the plots, also they are pushing for 'no ropey little sheds littering the site at all'.
They have not consulted the other PC members and has stated that they are advising that it would be unwise tochallenge these points in the next meeting as it would not be to our benefit.
I feel that they are  being a complete power crazed control freak operating outside of the group that they are chair of.
I also feel completely stupid for thinking that they were genuinely interested in the project but they are just playing some freakoid power game.

Well I feel better for getting that off my chest. The point is they should have said they disagreed to our faces and I feel like it has been a verbal threat to us to shut up and put up.

well, we decided not to respond to the email and went to the next meeting. The points were brought up and the rest of the council didn't vote the points in HAa rah.
Got told that we couldn't have a shed without planning permission, we reckon this is a red herring, as it is a temporary structure. We will need to look into this one.

Good thing was that by not responding to this and just sitting tight it all has come our way.

and we are now on , yes ON our land.
It's been measured and pegged showing our boundary, it's huge, even larger than originally agreed.

And we are feeling terribly smug as the person who said no dogs was seen walking there dog off the lead across our site!
