ooh ooh! i might just asnwer my own question....is it a type of tomatoe? i just noticed the leaves and the size and shape of flower. but what kind of tomatoe has that sort of a flower? and what's it doing on my drive!

calendula

I think you'll find it is dulcamara, part of the solanum (potato) family   :-\

ah....i just looked that up and the flower looks the same. should i be worried that it's nightshade? and the fact that if you eat 6 or more berries it can cause paralysis?

calendula

all the solanum family have some degree of poison, including potatoes, so if you are worried about it dig it up and obviously don't eat the berries  ::)

oh no....i'm just wondering if it's poisonous to animals.....it's been there for a while. i wonder if it's been killing birds and stuff.

solanum crispum glasnaven.  (can't vouch for the spelling!)  No, shouldn't kill birds, they know to leave it alone.  However, keep an eye on it as it grows into a tree - not broad stem - and can tend to run a bit wild.  Lovely to look at though!

Doesn't look like Solanum crispum to me - the leaves are wrong. I'd bet some sort of nightshade thing.. I wouldn't worry about birds being poisoned, though. :)

The leaves look wrong for a nightshade, though the flower does look just like woody nightshade (S. dulcamara).
