Selling top-soil to it's owner

A builder I know won a contract to build 24 homes on what used to be a free-range chicken farm. He started by scrapping off all that fab top soil and storing it at his farm.
After the houses went up and were sold, the cheeky B***er sold the top-soil to the new house buyers for a small fortune.
How's that for cunning. (Or should that be conning?)
