Picture use?

I've been asked if a company can use one of my tomato pictures from my blog to represent the variety on a plant label. Their policy is the image won't be resold or loaned and only used for the correct variety. They'd like to have non-exclusive use of my image for printing on Tag labels and related Tag commercial use. Sounds ok to me but my experience of this is zero, is this all ok to agree to ?

I would say so although I'm no expert.  As they are wanting non-exclusive use then you are free to use it as you wish but look at any small print if it comes to a contract.  However I would expect some sort of payment if it is for commercial use - even a small amount. 
Moved to Portugal - ain't going back!

Can you confirm if you took the original image, did you grow the fruit? If its all yours then what could be the problem. Any suggestion of "trade description" error would be theirs. Did the company supply you the plant so that its truely an image of the intended marketed variety. I expect they know that you will be cheaper than a retained photographic studio. Will they acknowledge your copyright, so as to give you some "consideration " in subsequent years.? If you judge them to be genuine, why not find out whether they have other requirements. Could be a "nice little earner"

Thanks Ancellsfarmer, lots of things I hadn't even thought.
Yes my image and to the best of my knowledge the correct variety grown by me.
Cheaper cost I'm sure is prime, I think the time factor too, if they had to wait a season to take pictures before being able to use them.

I do hope you get paid, but suggest they make a donation to a charity if not.  Do they want some more?  Sounds like you might have a new career coming on.

Good advice, thanks. I don't think they want more pictures, I think it's a one off and more down to obscurity of variety than my talents!
