Returning faulty goods

I have a question regarding returning faulty goods.

With my christmas money, I bought two solar sets of flashing lights for my bicycle from an internet trader, one to go on my ankle and the other to go over a backpack.  One of the units works well, the other has never worked.  I advised the company and they sent me a return form.

I was just about to write the return address when i noticed noticed that they are making me return the faulty goods to the manufacturer and not to the internet trader.  Is this correct?  I thought I had the contract with the trader rather with the manufacturer?  And that the trader should take charge of faulty goods and replace them?

What should I do?  Appreciate any comments.

I believe that your contract is with seller and the seller has a contract with the manufacturer

If it was through ebay or Amazon, you can use the sites returns process to get a refund.

There is also some additional protection if you paid with a credit card.

Thanks macmac and Ellen K.  As suggested, I put it to them that my contract is with them as the retailer and not with the manufacturer and therefore I would ask for an address to send it that is theirs.   They did respond quite fast and sent me another returns form as email attachment, this time with their address.  So far so good.

Yes it was paid for by credit card, so that would be a way to get my money back, but I'd rather get a working unit  :)

Did you pay via pay pal there is some protection there but there is a finite time to claim?  I think you can register a dispute paypal which can be withdrawn later if the dispute is resolved.

I ordered something which took a very long time to arrive but in the end the dispute was resolved.

Here in England you have statutory law that states you go back to the seller and not the manufacturer, your contract is with the seller and unless the goods was bought from a private person or as damaged goods you have the right to a replacement or refund. See Sales of Goods act 1979. If you purchased them from the internet, then this is called distance selling and has no effect on your statutory rights.

Thankyou farmer,steve and Digeroo.  Unfortunately not Amazon, but an internet website.  Steve it was good to read that this makes no difference.  They still haven't sent a replacement  >:(
and emailed that they would need to get the manufacturer to agree that the item was faulty as well.  Yet again, the seller doesn't seem to accept that they have the contract with me.

Hope this will be resolved soon.  Appreciated the url info.

There has to be something in the Uk regarding sending faulty goods and returns as I have had two things in the past few weeks.

I bought the DVD complete series of Tenko and two discs were faulty, the company asked me to return the faulty discs which I did, but they have since said the fault is on their other sets too and told me to return the whole lot for refund and return postage costs.

Then I bough UK groceries from a store who air freighted to me. Bisto, canned tomato soup, Atora and salad cream, I bought a case of each, the packing was poor and the Bisto boxes had popped open and half the cans of soup were dented, so I contacted them.. they replaced eveything without question and reshipped it. I was very impressed, they even replaced the suet which had bumped boxes but was useable and sent a full case of soup again even though only half was dmaged. I was amazed.  I ended up with much more than I paid for.

I think you will be just fine Galina, just keep at them.

Did you pay by credit card?  This also gives you some protection.

My bank adviced me never to buy anything online except with credit card.  I did not have a credit card so the only use I make of it is online purchases, and it is then set up to clear from my bank account so nothing builds up.
