Well...The allotment societies will have to put up large notices stating
*If you enter an allotment you do so at your own risk. Plotholders will not be responsible for any accidents that might occur*

Am happy to go to jail. Haven't got that sort of money. I hear life is cushy in jail.

Ah yes, we could start our own prison plot.
Just think, three meals a day, no house work, and no dishes or laundry to worry about. Could treat it like a mini holiday. Worth the £400  ;D

If someone hurt themselves on your plot could you not have them arrested for trespass and criminal damage....

we were told about a t. leaf climbing over an allotment fence to get away from the police, there was a spike on top, hurt himself, sued the lottie and won !!  ??? :o

Well come on now folks lets get real here,there are tons of serious hazards on a lottie plot. eg

spraining ones ankle by slipping into a leek hole
inhaling too much odour from cow poo
over exhertion from chasing a slug
wrestling with a pigeon who has your brassica in his mouth
choking from quick growing couch grass( it takes hold real fast)
muscular atrophy from leaning on a spade
emotional stress from dealing with blight


I think we should all be insured against the above.

When we owned a garage and haulage business we were told by the local Police that if a person scaled our high fence and was bitten by one of our German Shepherds we could be sued. We took out extra insurance just in case!!

£5 Million is the standard Public Liability insurance and sets us back about £200 pa..

Jeannine, I once got a black eye from a Dutch Hoe. It was leaning against the post that has the tap that I drank from... as I turned on the tap, Hoe slipped, whack!... a friend of mine also got a black eye from a Dutch Hoe but that's another story...

Actually I once stood on a garden rake and contrary to popular belief it did not come up and hit me,it went right through my foot  and I needed surgery. Was in my own garden though XX Jeannine

OW!!!

I am always telling DH off for leaving tools laying around like this he is a horror for it....

Must check our insurance policy?! seems a bit bonkers to me!

Hmmm.  If you search the case law, there are very few successful actions by trespassers under the Occupiers' Liability Act.  The only exceptions seem to be where the occupier deliberately sets a trap, or where they could have reasonably foreseen that something would be attractive (especially to children) and would pose an obvious danger.

So there seems to be no problem in putting barbed wire on a fence, but you shouldn't dig a hole and fill it with sharpened spikes and conceal it with long grass.  Neither should you, say, leave a full water butt balanced precariously on a home-made stand.  You might know that you shouldn't lean on it, but you could reasonably foresee that a kiddy might pull it over on top of himself.  I guess that leaving a lemonade bottle containing insecticide lying around would be negligent too.

But my interpretation is that if your lottie is safe enough for invited visitors, then it's safe enough to protect you from lawsuits from trespassers.

In school my brother put a fork though his foot.

They took it out gave his a tetnis shot and sent him home with crutches.

He had a mini stroke later that year and his hand had to be operated on as the musles were paralysed and the doc said it was because the crutches were the wrong size!!

School said nothing and he got nothing.
