Hi Boston Eye,

Quote
Boston Municipal Charities was set up in the 17th century to manage the income from the site and use it for good causes in the town.

Do the 17th century documents say that the land was "to be allotted to the poor"
or something similar ?

I think I`d go back through the history of the site. Who gave the land and what was their intention, did they make any restrictive covenant for example?

Do their family still have a connection in the area? Will they get involved in any protest?

And I`d look at the set up documents of the charity.

Best of luck, keep us posted, Col

We are having a similar problem in Grantham. HOwever, ours in privately owned.... a good book is the allotment hand book which details law and allotments and had things in which our lawyer didnt know so worth a look! http://www.organiccatalog.com/catalog/product_info.php?cPath=63_194&products_id=2168

The first port of call woudl be the title deeds - i expect there would be a restrictive covenant on them.... so take a look.
